These Terms of Use govern your access to and use of NegocieloHoy.com, including our marketplace, subscription plans, promoted listings, AI-assisted lead tools, social autoposting, media tools, notifications, and related services. By using the platform, you agree to these Terms.
1. Who may use NegocieloHoy
You must be at least 18 years old, or the age of legal majority where you live, to create an account, publish listings, buy promotions, or use paid services. If you use NegocieloHoy for a business, you represent that you are authorized to act for that business.
2. Accounts and security
You are responsible for the information in your account, your password, and all activity under your account. Keep your contact details accurate so buyers, leads, support, billing providers, and automated notifications can reach you.
3. Listings, offers, and seller content
You are responsible for every vehicle, property, spare part, service, offer, image, video, description, price, location, link, and message you publish or submit. Content must be accurate, lawful, non-deceptive, and must not violate intellectual property, privacy, publicity, consumer protection, advertising, real estate, vehicle, financial, or other applicable rules.
NegocieloHoy may review, reject, edit, remove, hide, or limit content that appears unsafe, misleading, unlawful, duplicate, low quality, abusive, spammy, or inconsistent with the platform. We may also remove expired listings, inactive promotions, or media that no longer supports an active service.
4. AI-assisted tools
NegocieloHoy may provide AI-assisted features such as WhatsApp AI, website chat, lead qualification, suggested posting times, listing text, captions, translations, summaries, and promotional video generation. AI output may be incomplete, inaccurate, or unsuitable for your specific business. You are responsible for reviewing AI output before relying on it or sending it to customers.
You must not use AI tools to deceive users, impersonate others, collect information unlawfully, make illegal claims, give regulated professional advice, or send messages without proper consent.
5. Leads, messages, WhatsApp, email, and notifications
The platform may help capture leads and send alerts by email, WhatsApp, SMS, or in-app tools. You are responsible for responding to leads, honoring opt-out requests, using contact information lawfully, and complying with messaging, anti-spam, advertising, privacy, and platform rules.
WhatsApp, Facebook, Instagram, Pinterest, YouTube, payment providers, email providers, SMS providers, and other third-party services are operated by their respective companies. Their terms, policies, availability, approvals, limits, fees, or technical restrictions may affect how NegocieloHoy features work.
6. Social autoposting and third-party platforms
If you connect social accounts or authorize autoposting, you permit NegocieloHoy to create, schedule, publish, update, or manage posts based on your listings, promotions, media, and settings. You remain responsible for the content posted to third-party platforms and for complying with each platform's rules.
7. Subscriptions, promotions, credits, and payments
Subscription plans and per-ad promotions may include publishing capacity, promotion credits, priority placement, AI chat, social autoposting, notifications, and promotional media while the applicable listing or plan is active. Exact benefits, duration, prices, and limits are shown during purchase or in the subscription page and may vary by country, language, plan, or promotion type.
Payments are processed through third-party payment providers. Unless otherwise stated at checkout, fees are charged when purchased and may be non-refundable once a listing, promotion, AI service, media generation, or subscription benefit has been activated or delivered. We may correct pricing or technical errors and may refuse or cancel transactions suspected of fraud or abuse.
8. Prohibited activity
- Publishing false, misleading, illegal, stolen, counterfeit, unsafe, or infringing content.
- Using the platform for scams, phishing, spam, malware, scraping, credential harvesting, or unauthorized messaging.
- Interfering with platform security, availability, ranking, payments, analytics, or third-party integrations.
- Uploading content that is hateful, violent, explicit, defamatory, harassing, discriminatory, or exploitative.
- Misrepresenting identity, ownership, inventory, pricing, availability, location, financing, or affiliation.
9. Intellectual property and license to operate the service
You keep ownership of content you submit, subject to rights you grant us. By submitting content, you grant NegocieloHoy a worldwide, non-exclusive license to host, store, copy, display, translate, adapt, promote, distribute, create previews or videos from, and publish that content as needed to operate, market, improve, and protect the platform and connected services.
NegocieloHoy's software, design, branding, text, interfaces, workflows, and platform materials are owned by NegocieloHoy or its licensors and may not be copied or reused without permission.
10. Marketplace role and no guarantee
NegocieloHoy provides technology for publishing, promotion, communication, and lead generation. We are not a party to transactions between buyers and sellers unless explicitly stated. We do not guarantee listing accuracy, buyer quality, seller performance, traffic, ranking, sales, leads, social reach, search placement, or revenue.
11. Suspension and termination
We may suspend or terminate accounts, listings, promotions, integrations, or access to features if we believe there is a violation of these Terms, legal risk, payment failure, security issue, platform abuse, or harm to users, third parties, or NegocieloHoy.
12. Changes to the service or Terms
We may update features, prices, plans, availability, country support, policies, and these Terms from time to time. Continued use of the platform after changes means you accept the updated Terms.
13. Limitation of liability
To the maximum extent permitted by law, NegocieloHoy is not liable for indirect, incidental, special, consequential, punitive, or lost-profit damages, or for losses caused by user content, third-party platforms, payment providers, outages, AI output, buyer or seller conduct, or unauthorized account use.
